As we step into the new year, Floridians should be aware of several new laws that went into effect on January 1, 2025. From criminal justice reforms to building regulations, these changes could impact your rights and responsibilities. At Carlson Meissner Hayslett, we’re here to keep you informed about the laws that may affect you in the areas of personal injury, workers’ compensation, Social Security disability, and criminal and DUI defense.

The HALO Law: New Restrictions Around First Responders

The “Honoring and Listening to Our Officers” (HALO) law requires you to maintain a 25-foot distance from first responders who are performing their duties if they order you to move back. If a first responder (a law enforcement officer, firefighter, or other emergency medical personnel) asks you to move back and you fail to comply, you could be arrested and charged with a second-degree misdemeanor, punishable by up to 60 days in jail and a $500 fine.

If you’re charged under this law, our criminal defense team is ready to evaluate your case and help you protect your rights.

Social Media Restrictions for Minors (HB 3)

The state has introduced restrictions on social media access for minors. The law requires social media platforms to terminate accounts created by children under 14 years of age. Minors aged 14 to 15 must obtain parental consent to maintain a social media account. Enforcement of this law is expected to be delayed until the courts review its constitutionality.

This same law also requires commercial websites that distribute “material harmful to minors” to use approved methods to verify that users attempting to access the material are 18 years or older. Some websites have opted to block access to Florida entirely instead of implementing age verification measures.

If you’re accused of violating online laws, our team is prepared to defend your rights and address the complexities of these new regulations.

Enhanced Protections for Seniors (SB 556)

Financial institutions now have more authority to investigate and freeze transactions if they suspect financial exploitation of seniors (65+) or vulnerable adults. If you or a loved one are victims of financial exploitation, this law offers additional protections. We can help you take legal action and safeguard your finances if you believe that you have been the target of a financial scam.

Workers’ Compensation Updates (SB 362)

New changes to Florida’s workers’ compensation laws increase witness fees for healthcare providers and raise the reimbursement limits for physicians. If you are injured at work, these changes could influence the costs associated with medical testimony during your claim.

Our experienced workers’ compensation attorneys are here to ensure you receive the medical care and benefits you deserve.

Streamlined Building Permits (HB 267)

Replacing windows, doors, or garage doors in existing homes just got easier. Under this law, these repairs no longer require sealed drawings from a design professional so long as specific state regulations are met. Homeowners in Tampa Bay can expect a faster permitting process, reduced costs and less delay when these repairs are needed.

Voter Registration Protections (HB 135)

This law prevents political party affiliations from being changed without written consent, addressing previous errors in voter registration systems.

Improved Dental Insurance Protections (SB 892)

New rules prevent insurers from denying claims for previously authorized procedures and restrict payment methods that could burden dentists. These reforms reduce administrative roadblocks, making it easier for patients to access dental care.

Modernized Trust Laws (HB 1093)

Florida updated its trust laws to address the allocation of trust and estate receipts, disbursements and jurisdictional disputes when a Florida trust doesn't specify such terms. These changes should provide for greater estate planning flexibility.

Affordable Housing Bonds (SB 7054)

This law increased the number of private activity bonds that can be issued in Florida each year to finance improvements, projects, and programs serving public purposes and benefitting the social and economic well-being of Floridians.
