What is the Rebuttal Phase of a Criminal Trial?
After the defense has rested their case, the government has the opportunity, if they so desire, to call witnesses to present evidence to rebut or refute what the defense provided in their case in chief.
This is called a rebuttal case or rebuttal phase. The government, if approved by the judge, may call witnesses to contradict what defense council allocated during the testimonial phase of their case in chief or present other evidence that directly relates to rebutting what the defense brought forth in their case.
Rebuttal case or rebuttal case in chief is after the defense puts on their case.
