What is Embezzlement and What are the Criminal Charges?
When we think of an embezzlement felony, we usually think of a bank manager or a bank teller who’s slowly taking from the bank over a period of time- they are embezzling funds. Well, that is partially right. Most jurisdictions make embezzlement a special type of crime because it involves a couple factors.
- Theft or Larceny: This means that a person diverts funds, cash or assets from the owner or the person it belongs to, to themselves.
- Relationship to the Victim: Relationship between the person who is taking the money and where they work or where they live. For example, a bank manager, as I talked about, is taking funds from the bank. He is an employee of the bank or the institution. He has a theft or a larceny and he has a relationship to the victim. It’s those two things that move it from a theft, which may be a lower degree crime to embezzlement.
