What is Demonstrative Evidence?

Hi, this is attorney Kevin Hayslett and the question is – What is demonstrative evidence?Well, demonstrative evidence is evidence that demonstrates something to a jury; such as a map, grid, or a chart. In order for the demonstrative evidence, like a map of the murder scene or the map of the robbery area, to be admitted into evidence the Trial Court meaning the Judge has to determine that the following three criteria are met:

1.    It is Relevant
2.    It is Material
3.    It would aid the trial of fact or Jury in determining the truth of one of the elements in the case.

If the Trial Court determines that the demonstrative evidence is relevant, is material, and that it would help the Jury, then that map, grid, or graph would be admitted into evidence. Meaning that the Jury would actually get to see it and that the witnesses could testify about it. So demonstrative evidence is evidence that demonstrates something to help a Jury with determining whether a person is guilty or not guilty.
