What is an Administrative Suspension Hearing?

First, it is important to note that there are two components to a DUI or DWI case:

1.    The criminal side
2.    The Administrative side

The Administrative side deals specifically with the status of your driver’s license. In most states, or jurisdictions, when you are arrested for DUI, the law enforcement officer will take, or confiscate, your driver’s license. This means the state will suspend your driving privileges for the period of time set by that individual state.

In order to invalidate that driver’s suspension, you must apply and be successful at an Administrative hearing— each state has different rules. There is usually a 10-day time period for you to request a hearing. It’s very important if you have been arrested for DUI to request an Administrative hearing of your driver’s license.
