How to Avoid a DUI Arrest

It’s either a holiday time like New Year’s Eve, St. Patrick’s Day, Labor Day, Fourth of July, Halloween; those are the times that we typically tend to go out and be social and drink. I tell folks that there are a number of ways to prevent them from being placed in a position of being arrested for DUI. The first and foremost, obviously is do not drink and drive. That is a message made clear through PSA’s and other information to the public. 

If you are going to drink and drive ensure that you take the following precautions:

  1.  If you are you going to drink, eat some food. Studies show that if you consume food while drinking, it will keep your blood alcohol level from peaking.
  2. Plan to have a designated driver. Or if you are going to drive, ensure that the following is in place:
       a.    Make sure that your headlights and taillights are not out
       b.    Make sure that your license and registration are valid.
       c.    Make sure that your vehicle is in proper working order that way law enforcement does not have a basis to pull you over
  3. Plan ahead as far as your license, registration, and insurance card is concerned. Your license, registration, and insurance card all need to be up-to-date. If you are pulled over, do not fumble through your wallet while you are looking for your license, registration, or insurance card. I advice folks to take those three items and clip them to their car’s visor mirror or store them in a safe place in the car so they are easily accessible.
  4.  If you are driving, do not take the routes that are most populated. If you are out driving between 10 PM and 3 in the morning, the main areas of your city or town are the areas that DUI officers will stake out. If you are going to go from point A to point B try to take an alternative route.

Don't give too much information at the DUI stop

If and when you do have contact with law enforcement, make sure that that contact is one that is pleasant. You do not have to give them a lot of information. What I mean by that is do not give a long, lengthy speech about where you have been or how much you have had to drink. Keep it to short answers. Ensure to keep the time talking with the officer to the least amount of time possible. Your goal is to not be arrested by that law enforcement officer.
