Are Plea Bargains Enforceable?
In most jurisdictions, plea bargaining takes place in 95% of the cases. That means your lawyer and the prosecutor agree on a disposition and you enter that plea in front of the Judge; however, in most plea bargaining cases, the Judge must approve the plea. That means if there is a disposition or agreement between the parties, and the Judge does not agree, the plea cannot be accepted. Remember: plea bargains, more likely than not, require the approval of the Court.
