The vast majority of those cases are denied, about 75 to 80 percent of all cases. If you are denied, we will file the first appeal which is called the request for reconsideration. At that level, you are asking social security again to take a second look at the case. Usually, they’ll give you that decision in a month or two. Most of those claims end up having to go in front of a federal judge.
Lately, the process for getting to court has varied because of the COVID-19. It used to be 12 to 18 months; but, we are actually seeing cases end up before a judge within 6 to 8 months.
