As experienced social security lawyers in Florida, we know that the process for getting social security disability benefits is unfortunately time-intensive. For a lot of our clients, it’s one of the hardest processes that they’re going to have to go through. When you first apply, you get an initial decision typically within three or four months. During that time period, social security is reading your medical records and evaluating your claim. They might even send you to one of their doctors.

The vast majority of those cases are denied, about 75 to 80 percent of all cases. If you are denied, we will file the first appeal which is called the request for reconsideration. At that level, you are asking social security again to take a second look at the case. Usually, they’ll give you that decision in a month or two. Most of those claims end up having to go in front of a federal judge.

Lately, the process for getting to court has varied because of the COVID-19. It used to be 12 to 18 months; but, we are actually seeing cases end up before a judge within 6 to 8 months.
