Debido a el estado debil de nuestra economia, algunos trabajadores estan preocupados de reportar sus lesiones de trabajo. Varias veces este ano he tenido la experiencia de hablar con trabajadores que han sufrido heridas en su empleo, pero decidieron no retener un habogado de compensasion o reportar sus heridas a sus empleadores.  Obviamente, una persona herida en el trabajo podria estar preocupado que estan riesgando su empleo si reportan la herida.  La realidad es que usted no debe tener miedo de reportar una herida laboral si se lastimo en su trabajo.  Bajo ley de la Florida, es ilegal que un empleador lo vote de el trabajo o lo castigue por tener un reclamo válido por sus lesions laborales. Un patrón que lo despida por reporter su herida, o que de cualquier manera lo castige, podría abrir la puerta para un pleito por despedirlo sin causa. Además, reportando una herida y pidiendo beneficios de el systema de compensasion no es la misma cosa como meter un pleito contra su patrón. Cuando usted reporta una herida en el trabajo, usted está pidiendo simplemente los beneficios que ya le deben a usted de una compania de seguro.  Otro punto que debe tener presente es que usted realmente nunca sabe como una lesión podría progresar. Lo  que comienza hoy como un dolor de espalda leve o simple topetón a la cabeza podría desarrollar en una condición seria y más dolorosa en un poco período de tiempo. La ley de compensasion de la Florida solamente le da 30 días a partir de la fecha de su accidente o lesión para reportarselo a su patrón. Desafortunadamente, trabajadores que esperan para reportar sus accidentes o lesiones hasta que la condición se empeore riesgan que sus reclamos sean negadas por ser reportadas tarde. Si usted le informo a tiempo su accidente o lesión a su patrón pero su patrón le ofrece asistencia médica inmediata, es muy importante que usted hable con un abogado de compensasion por heridas laborales lo mas rapido posible. Su abogado podrá notificar la compania de seguro de compensasion de los trabajadores de su lesión y archivar un reclamo directamente.  Algunos trabajadores que están preocupados de perder sus trabajos deciden simplemente utilizar su propio seguro médico privado para obtener asistencia médica, en vez de reporter la lesión con su patrón y obtener el tratamiento medico a través del sistema de compensasion. En mi experiencia, esto es casi siempre un error. Si usted reporta una herida válida, la compania de seguros de compensasion tiene que pagar el 100% de el tratamiento médico autorizado y requerido. Esto incluye sus medicaciones, consultas, el tratamiento, la terapia e incluso el millage para atender citas médicas. Sin embargo, si usted elige utilizar su propio seguro médico personal, tendria que pagar los deducibles y co-pays directamente fuera del bolsillo de su familia. Si su lesión progresa al punto que usted requiere asistencia médica continua, o una cirugía, usando su propio seguro médico va a ser muy costoso. También, si usted tiene que faltar tiempo del trabajo debido a sus lesiones, usted no tendra la opción de obtener pagos por el sueldo perdido de su seguro medico privado. Sin embargo, si usted a reclamado los beneficios a traves de el systema de compensasion, la compania de seguros le tiene que pagar parte de su sueldo perdido si un doctor de compensasion lo saca de trabajo por sus heridas. Claramente, los empleados que decided no reporter sus lesiónes y utilizan su seguro médico podrían terminar con  cuentas médicas costosas y tiempo faltado sin pagar del trabajo.  Aunque es normal estar preocupado de reporter una lesión de trabajo, es importante tener las prioridades correctas en mente. Para protegerse a usted, su potencial de ganancia futura y su familia, usted debe notificar a su patrón inmediatamente si usted se lastima en el trabajo. Because of the uncertain state of our economy, some workers are worried about reporting their workplace injuries. Several times this year, I have had the experience of speaking with workers who have been injured at work, but decided not to retain a workers compensation attorney or even report their injuries to their employers. Understandably, a person hurt at work could be worried that they are jeopardizing their job or risking the wrath of their employer by reporting an injury. The reality is you should not be afraid to file a claim if you are hurt at work. Under Florida law, it is illegal for an employer to fire or punish you for having a valid worker’s compensation claim. An employer who fires you for filing a claim, or in any way punishes you, could be opening the door for a wrongful termination or a retaliation suit. Besides, filing a claim with a workers compensation carrier, and hiring an attorney to seek those benefits, is not the same thing as filing a law suit against your employer. When you report an injury and file a workers compensation claim, you are simply requesting benefits you are already owed from an insurance company. Another point to keep in mind is that you never really know how an injury could progress. What started out today as slight back pain or a simple bump to the head could develop into a serious and more painful condition in a short period of time. Florida’s workers compensation law only gives you 30 days from the date of your accident or injury to report it to your employer. Unfortunately, workers who wait to report their accidents or injuries until their condition worsens risk their claims being denied as untimely reported. If you timely report your accident or injury to your employer but your employer fails to provide you with immediate medical care, it is very important that you speak with a workers compensation attorney as soon as possible. Your attorney will be able to notify the workers compensation insurance carrier of your injury and file a  claim directly. Some workers who are worried about their jobs may simply decide to use their own private health insurance to seek medical care, instead of reporting the injury with their employer and getting medical care through the worker’s compensation system. In my experience, this is almost always a mistake. If you report a valid workers compensation injury, the insurance carrier has to pay 100% of all authorized and required medical care. This includes your medications, consultations, treatment, therapy and even the mileage to attend medical appointments. I you choose to use your own personal health insurance, there will likely be deductibles and co-pays which you will be required to pay out of your family’s pocket. If your injury progresses to the point that you require continued medical care, or even a surgery, then using your own health insurance could prove to be very expensive. Also, if you end up having to miss time from work because of your injuries, you would not have the option of being paid wage loss benefits from your personal health insurance provider. However, if you have a workers compensation claim and are taken out of work by your authorized doctor, the insurance carrier would be responsible for payment of wage loss benefits. Clearly, employees who choose not to report an injury and instead use their health insurance benefits could end up with costly medical bills and unpaid missed time from work. Even though it is understandable to be worried about reporting a work place injury, it is important to have the right priorities in mind. In order to protect yourself, your future earning potential and your family, you should notify your employer immediately if you are hurt at work. Clearwater, FL (PRWEB) October 20, 2010 Philadelphia Phillies outfielder Tyson Gillies can finally get back to the game of baseball now that all charges against him have been dismissed. On August 20th Gillies was arrested for felony possession of cocaine arising out of a June 11th incident, which occurred in Clearwater, Florida. According to Tyson’s Attorney, Kevin Hayslett, with the law firm of Carlson, Meissner, Hart & Hayslett P.A. "the State Attorney’s office came to the conclusion that Tyson neither possessed nor had ingested any controlled substance". According to the arrest affidavit Gillies was leaving a nightclub, and was walking along Highway U.S. 19 in Clearwater when he was offered a ride back to the team hotel by a Pinellas County Deputy Sheriff. Upon arrival at the hotel Gillies exited the police cruiser. At some point later the Deputy observed the presence of what he believed to be cocaine in the backseat compartment area of his vehicle at or near the location where Gillies had sat earlier. The substance was submitted for testing and came back positive for cocaine. Based upon these facts Gillies was arrested for one felony count of possession of cocaine. Gillies retained high profile Florida criminal defense attorney, Kevin Hayslett who had previously represented Hulk Hogan’s son and many other professional athletes. Hayslett entered a not guilty plea at The Circuit Court of the Sixth Judicial Circuit of the State of Florida, in and for Pinellas County, case number CRC-1018004CFANO, State of Florida vs. Tyson Gillies, on his client's behalf on September the 1st. According to Hayslett, he sent the prosecutor evidence of his client’s innocence. “I was able to provide several highly sensitive drug screens that all came back negative as well as some very compelling additional information,” said Hayslett. According to Mark Hunter with the Kamloops news, who further quoted Hayslett “a drug screen that was done within hours of the incident showed that Gillies clearly had no drugs at all in his system …after they had the benefit to see the evidence that I was in possession of, they determined to drop all charges and basically vindicated Tyson.” According to Kamloops News, Tyson Gillies had this to say. “I know who I am and what I’m about as a person and was stunned with the things I had to go through. I want to thank my family, friends, and the Phillies for their support and being behind me since Day 1. My attorney, Kevin Hayseltt, did a fine job. He believed in me.” Tyson injured his left hamstring back in May and came to Clearwater to rehabilitate. Now that the hamstring is good condition, surgery isn’t needed. He will however, spend the next couple of weeks training in Vancouver with running coach, Brian Hoddle. With his legs being an important factor in his life, Tyson is determined to be back in perfect shape before returning to spring training in Clearwater in early 2011.

Philadelphia Phillies outfielder, Tyson Gillies, can finally get back to baseball now that his attorney, Kevin Hayslett, got the charge of possession of cocaine dropped.
