Drugged Driving Surpasses Drunk Driving as Cause of Fatal Crashes

Driving while under the influence (DUI) of drugs is on the rise. Perhaps it is no surprise. Opioid abuse is a serious public health issue in the United States. Drug overdose is the leading cause of injury death in the country, according to the United States Department of Health and Human Services. And marijuana usage is also climbing, with thirty states and the District of Columbia legalizing the drug in some form.

But for the first time, statistics show that drugged driving surpassed drunk driving as the cause of fatal car crashes. According to research conducted by the Governors Highway Safety Association (GHSA) and the Foundation for Advancing Alcohol Responsibility, of the fatal car accidents in 2015, forty-three percent of drivers that were tested had used a legal or illegal drug, surpassing the 37 percent of drivers who tested above the legal threshold for alcohol.

Driving while under the influence (DUI)

All states have laws regarding driving under the influence (DUI) of alcohol or drugs. The legal standard for determining alcohol impairment is a blood alcohol concentration (BAC) of 0.08%. The standard for impairment due to drugs is more difficult to establish. Testing is complex and usually requires a blood test. Delays in testing for drugs may allow the drug to metabolize, which may not reflect the concentration present in the driver’s system at the time the accident occurred. Furthermore, the effect of drugs – and the different drugs available – can vary significantly from one person to the next.

Awareness of the effects of driving under the influence of alcohol is fairly widespread. Unfortunately, the risks of driving while under the influence of drugs is not. In surveys of regular users of marijuana in Washington and Colorado, almost none of the individuals surveyed thought that marijuana use impaired their driving ability.
