Why is it Important to Know Why You Were Pulled Over?
Most attorneys that practice in the area of DUI law will focus first and foremost on the basis of the traffic stop. Most states and jurisdictions will require law enforcement to have certain basis to conduct a traffic stop in a DUI arrest. For example, if the law enforcement officer pulls you over for weaving, many times to justify a valid traffic stop, they must articulate that the weaving affected other traffic; or if you’re cited for speeding, they must have certain documents to support their basis for the speed. It is very important to understand the traffic stop does not pass Constitutional muster, the case will be dismissed—this is under the Fruits of the Poisonous Tree Doctrine. That means, if the stop is bad, everything after that point must be suppressed and your case is dismissed.
