What is a Direct Examination in Criminal Trials?

During the presentation of the case, the government will question witnesses during direct examination. Direct examination means the government lawyer or the prosecutor will elicit testimony from the witnesses, which is usually done in an open-ended fashion.

Open-ended questions during direct examination can include the following:
•    What did you see?
•    Where were you located?
•    How did it look?

The prosecutor can not use close-ended questions or start with “isn’t it true”. They can not lead the witness to the testimony because it is very important under the rules of evidence. That witness must provide information based upon what he or she has knowledge of or what he or she observed.
